while you are correct on how NDAs CAN be used maliciously, that is not what's happening in this situation at all. In this case an NDA is being used by an organization (the HICU) to come to a legal agreement with the owners of the Unofficial Homestuck Collection to give them permission to use copyrighted work with guidelines put in place, the UHC didn't want to follow these guidelines so they stalled until the HICU was backed into a corner. No matter how much work they put into the archive it is still directly Andrew's work being used without permission. They are using copyrighted work, you can't just do that without the rights. The Homestuck Independent Creative Union tried to give them the rights and they refused the conditions, so there was nothing to do but send a cease and desist. The NDA was not malicious in any way.
