Thank you for writing your post, especially getting in contact with eyes5 to ask for more information. The only thing i have to add information-wise is that i looked a bit into The Overseer Project and i found more info as to what happened. (Realized i can just look at T.O.P. Unofficial Discord to see if anyone talked about it and i struck gold.)
The Overseer Project has been revived, though it's downtime before 2023 was because of no one hosting the servers for it (Explained in Tangent 1) and not the fake C&D. I did look into the C&D a bit on the discord (Can't believe this never came to mind before now.) and there's an explanation from Thell (Y'know the person who wrote the tumblr post which we can't access anymore, Who as you can see also deleted their discord account at some point? It's definitely them since they were thanked for writing this response on discord. Again, explained in more detail in Tangent 1). Screenshots below.
(note: Thell is a nickname, Thelle is also a nickname, Uncle Thell is yet another nickname, the real name was Thellere as far as i can tell.)
Mr. Cohen here is probably referring to the Director and writer of Hiveswap Act 1 in case anyone was wondering[1]. Also this confirms that V3 turned into an original game due to the fear of a real C&D making members of the team nervous and not what i stated before where the C&D came sometime after V3 became an original game.
Tangent 1: A quick looking at Thell's name on the discord says that Thell just disappeared suddenly with all the code a few years after the message above. They were also the one hosting the Overseer V1 and V2 servers too so it went down with them. Nobody knows why Thell just suddenly disappeared, it just happened. Hopefully they're doing well. As my previous post shows, they were able to bring V2 back with an older version of the codebase.
So we now have a clearer idea on what happened, we know for a fact the C&D was called fake by WP but we also know for a fact that the C&D came from an official email. Well there was a bit of a discussion on it but nothing really conclusive, It seems like we never got a real answer on that outside of it maybe being a successfully spoofed email? Which admittedly is possible if the WP mail servers weren't set up properly.[2] I haven't been able to find the official WP response but that seems to be the official WP line.
Tangent 2: Apparently Makin worked on Overseer V2 back in the day, specifically on content implementation.
Sidenote: The discord is unofficially official, not being made by the devs but being used as the main hub for communication for Overseer by the developers to the community even before the reboot. So i was sorta wrong on it. It is basically the official one despite it's name.
I've basically just been waiting for the official response for these past few weeks, so unless something notable happens before the official response or if someone wants my thoughts and opinions on things for whatever reason, i don't really have anything else to add.
Also yeah, fair on not trusting reddit comments for information, that's like a last resort for me tbh if there really isn't anything better. Especially when they're based on second hand information, like i still don't know if James Roach ever responded to this to be honest. But well, i guess it isn't very important anyhow. I was mainly trying to figure out what happened and now i got the good enough answer of "probably a fake C&D but maybe not if WP just lied about the C&D being fake for whatever reason". (And i mean "for whatever reason". Literally anything you can imagine could be the reason why WP is lying. But either way it doesn't really matter now.)

HONESTLY thank you for these writeups! its good to have this kind of stuff documented, somewhere. because discords are not a reliable backup (if you lose the data due to a server wipe, discord basically doesnt keep any useable copies of the server for you to restore them :') found this out thru experience when the mspfa discord got crunked) and also they are difficult as fuck to navigate through if you dont know how to use the search function properly (when it bothers TO work properly). having it all laid out on a forum like this, where it can be backed up in multiple ways, is always a good thing. so thank u for ur good work!
