Hussie has complete control of the Homestuck brand, at this point. Anything technically illegal being enforced is entirely on Hussie. If they are fine with the work, they can simply not threaten to sue people. This saves them money, time, and stress, and extends this courtesy to the fan work creator as well. Gio also immediately complied with the cease and desist he did receive, and it wasn't enough. Hussie has no rights to the UHC reader, and therefore can't legally request that it be taken down. They did anyway.

Hussie themself responded to an email and randomly admitted that they didn't credit an artist who worked on Hiveswap because she was on bad terms with the company. Is this capital A Abuse? I don't think so. But it does display that there was some bad conduct that Hussie seemingly did not think was bad. Even if this was the only thing in this vein that supposedly happened, it would still be rather damning...

It distresses me how many of the rebuttals in this thread are based off of false information that is easy to verify. Unless you believe that everything Gio said in his article is STRAIGHT UP FAKE (which is your right. Believe that if you want. It is less rhetorically shaky, anyway.), which no one here seems to believe, you have to at least accept his premise a little bit. If this happened as Gio describes it, it is really bad.

Also, to address the sealioning claims... You can't really make those when you are actively engaging in a discussion thread about the topic. He might not say "hey go continue to make this person's life miserable" but he does know what to show his audience of ragebait-addicted reactionaries in order to make them do it seemingly of their own volition.

i know it was a bit obscured because there were a lot of posts made while i was writing but i was talking about the whole "licensees being evil and proof that hussie is controlling everything/everyone" discussion happening a bit earlier, not about UHC but instead about HICU and how/why I think its a good idea actually.

and also i brought up not knowing the exact licenses because there are a very many of them of a variety of kinds, some of which are very hands-off. I have a font pack where the stipulation for being free to use for both personal and commercial works is simply to follow the creator on social media. Which is very silly but these are some pretty good fonts so even though i have truly no idea how that could reasonably be enforced, or what happens when the social media sites used no longer exist, i follow regardless.

I do not use twitter or bluesky. I have seen no one provide screenshots of Gio making such comments, the closest thing I have seen is an old tweet where Gio snarks that WP is not available for comment. the Gio articles themselves which were the subject of legal campaigns rather than any tweets he made primarily place all the blame and moral failings on Andrew hussie, an eccentric and highly litigious millionaire. comments about his team members rarely take center stage in his writing.

This thread has gone. Way off track I feel. We should all just ignore the Atlas PFP and try to have a serious conversation here. No matter how subjectively you look at this, if you still absorb the facts of the matter, Hussie was absolutely within her rights to do all of this. Which was the discussion point of the thread. I think we should all be focusing and discussing that instead of getting sidetracked so much. I believe Gio is a bad faith actor for numerous reasons, but that is ultimately not the point of the thread. It's if Hussie was in his right to take down Gio's fork of the UHC, which he was.

But Hussie wasn't within their rights to take down Gio's fork of the UHC. They were within their rights to take down the asset pack (their work) but not the reader (not their work.)
According to Gio they took down the reader as well.

The more I learn about the history of Hussie vs Gio, the more amazed I am Hussie didn't drop the hammer on him years ago. About the only reason I can think of for him NOT issuing a takedown notice (never mind trying to cut a deal!) is that it would discourage other people from hosting a Homestuck mirror, and given the botched and unfinished Viz site restoration, that would have been a problem. If you decide to assert your copyright against someone, it's legally maaaaaaybe a little tricky to say "I won't assert them against these other people, on the basis that they don't hate my guts and have never destroyed one of my projects by orchestrating a hate campaign against my staff." Even if in common sense terms, that's a wholely reasonable distinction to make.

Hey I had a whole thing written out but I'm really just unhappy at being cast as a henchman in some archvillain's scheme earlier this morning, so lemme just say I'm not with mr. atlas shrugged over here. I do still think it's wrong to be so dismissive of anyone skeptical of Miles's post or Hussie's behavior and just because Gio sucks doesn't mean every word he types is a lie, but I really am not here to make enemies and I would prefer not to be placed with the obvious concern-troll just because I'm not taking anyone at their word alone. And yes, that includes Gio. I think where there's smoke there's fire but ultimately outside of direct statements and quotes I am guessing, but I think I have a right to trust my gut when Homestuck isn't making specific denials. I'm not part of Gio's "boy's club" for that. Though it's also because Makin is in that club and I don't want to talk to him.

Anyway I'm gonna refrain from posting more in this thread now because clearly it does not lead to joy for me.
