I know Gio would've used the opportunity to slander Hussie no matter the situation, and one of my first doubts when the situation came about was why Gio was so insistent on his position when he knew that things weren't going to work out the way he wanted. It's just that from my understanding Hussie was the one holding the gun, so they could've just looked past whatever Gio was trying to do and get straight to the DMCA. But oh well, we can only speak in hindsight after all.

does anyone else remember when it was considered a dick move to sell fanwork based on other smaller artists work? that prior to having more Official merchandise both Homestuck AND Undertale asked fans not to sell things with the exception of one-off commissions and/or contacting them to come up with some kind of agreement. and now I’m not saying No One had a problem with this I’m sure people did but in my experience most people found this reasonable (and still do this kinda “don’t be an asshole” mindset applies for many webcomics, “closed species”, bandcamp musician, and so on)

To me, and mind you I have no idea what exact licenses are being given/agreed upon here, this is an Understandable attempt at finding a balance point between making fandom happy and creatively prolific while also making it so that at least some of the bigger projects aren’t like Technically illegal as I said before in a perfect world none of this would ever be necessary but We live in a world where copyright not only exists but is strong enough for people to believe that having More Of It is what is going to stop various AI projects and the panthers will never eat Their face and so on.

people settle out of court all the time. two times so far, Hussie has made a libel threat over these articles and backed down as soon as faced actual defensive legal representation. In Sarah z’s case she even received a (snide, backhanded) apology.

Generally the reason a someone settles out of court isn't because they 'got their ass beat' it's that they either concede the time and effort isn't worth it or are aware the judgement isn't going to be in their favor, and usually comes after quite a bit of litigation, no one gets a legal threat and goes 'oh I'm fucked here's a bunch of money' lmfao. The reason someone settles out of court is so that the amount paid can't be publicized and if another case like that happens in the future the defense can't go 'well they gave the last guy this much money, so we need that much at least.' genuinely stop talking out of your ass you are just embarrassing yourself and Gio.

I don't think you know how courts work in general. Go look up the mcdonalds scalding case and ruminate on it then tell me Hussie didn't have any grounds to stand on lmfao. Sarah Z was part of an organization, Standard , that offered legal services to defend their employee YouTubers. they had more than adequate resources to defend her case. Gio mentioned paying for a lawyer out of pocket, but this was still enough to dissuade Andrew from pursuing a libel case.

Again you're assuming the fact that they had a lawyer dissuaded them and not the fact that it'd be PR suicide to sue Sarah Z or Gio for making their dumbass slanderous callout posts. You're in here screeching about the THREAT of litigation, imagine if Hussie had actually sued them!

I don't know if it's a good idea for me to be involved in these threads but people here seem to be knowledgable on the matter; what exactly was bad about Sarah's video? She seemed to genuinely operate on wanting to share information as neutrally as possible and seemed to just be dragged around in circles when asking to clarify what part of her video was wrong or misinformed so that she could edit or ammend what was said.

I don’t think Hussie should have taken either of them to court because it would be impossible to prove any malicious lying occurred, and I therefore find it strange that so many people here are happy to assume Gio is malicious liar.

the articles claim that Hussie paid TOG to work on act 7 and that hussie shut down WP NYC quickly without informing employees, and that he later refused to credit many of those artists in Hiveswap. Hussie admitted to all of these things during the Sarah Z ordeal. so, what lies?

so I don’t know When you watched the video but the disclaimer about taking things with a grain of salt was only added After people complained that her primary source of information was gio. she did not reach out to any member of the HS team as it was at the time before making the video, and did not care to see what they had to say when they reached out afterwards.

now looking at the shitstorm plaguing this forum with people proving on multiple accounts gio being just factually incorrect or leaving out important tidbits of conversation.

do you see what the problem is? using a faulty biased source, only (half)admitting to that being the case after called out on it, and refusing to engage with any actual person directly involved with Homestuck/Hiveswap does not make a good well-researched video regardless of how well edited and articulated it may be. I genuinely have not watched a single video of hers since then

It's funny that gio and sarah z ended up being from a similar branch of wanting to jump on drama more than anything else. bloggers and youtubers handshake emoji lacking rigorous research and sourcing (when theyre toooo scawwwy O_O) but wanting to call themselves journalists or serious people.
